Access to Information Manual

The Promotion of Access to Information Act 2 of 2000 gives you a right to request records held by a private body. This manual explains what Oztec (Pty) Ltd holds and how to ask for it. The exemption that once excused small private bodies from having one lapsed on 31 December 2021 and was not renewed.

Under section 1 of PAIA the head of a private body is its Information Officer by operation of law — no appointment is required. Section 56(a) of POPIA makes a deputy optional ("if any").

Processing of personal information
- Purpose. Providing and billing for website design and hosting; responding to enquiries; marketing our own service within the limits of section 69 of POPIA; meeting tax, accounting and employment obligations.
- Categories of data subject. Clients and prospective clients; the people who contact our clients' websites (for whom we act as operator, not responsible party); suppliers; employees.
- Information held. Names, business names, contact details, addresses, billing details, correspondence, and — as operator — enquiry submissions made to our clients' websites.
- Recipients. Our clients, in respect of their own enquiries; our email, hosting and banking providers; our accountant; SARS and other authorities where compelled.
- Planned transborder flows. None. Hosting and data are in South Africa.
- Security measures. Encrypted transport, access-controlled databases, restricted administrative access, daily backups with 30-day retention, and revision history on all site content. This description is general by design: section 51(1) asks for enough to permit a preliminary assessment, and publishing a control inventory would itself be a risk.
How to make a request
- Use Form 2 of the PAIA Regulations, available from the Regulator's website.
- Send it to the Information Officer at xien@oztec.co.za, or by post to Durban, ZA.
- Identify the record and yourself, and say how you would like to receive it.
- If you are acting for someone else, include proof of your authority.
- Say which right you are seeking to exercise or protect and why the record is required for it — section 50(1)(a) makes that a condition of access to a private body's records.
We respond within 30 days (section 56), extendable once by up to 30 days where the request covers a large number of records or requires a search elsewhere. We will tell you if that happens, and why.
Fees
The request and access fees prescribed in the PAIA Regulations apply. There is no fee for a request for your own personal information. We will tell you what is payable before doing the work.
Grounds for refusal
Chapter 4, Part 3 of PAIA. The grounds most likely to apply here are the mandatory protection of a third party's personal information (s63), the commercial information of a third party (s64), information supplied in confidence (s65), and legally privileged records (s67). If we refuse we will tell you which ground we rely on and what you can do next.
If we refuse or do not respond
There is no internal appeal against a private body's decision. You may complain to the Information Regulator or apply to court within 180 days.
Availability
Section 51(3). This manual is available:
- on this website, at this address;
- at our head office for inspection during business hours, free of charge;
- to any person on request, on payment of the prescribed fee;
- to the Information Regulator on request.
Reviewed and updated as the business changes, as section 51(2) requires.
